		<description>I have been a law enforcement attorney since 1995. I teach Use of Force Law. Here is my concern with the case.It does, indeed, establish a separate standard for TASER.  The Court squarely places the TASER in a limbo somewhere between intermediate and deadly force. No other Circuit has done that so there is a clear conflict among the circuits...ripe for the Supremes, don&#039;t you think? As for viewing the evidence in the light most favorable to the plaintiff....remember what the Supreme Court did in Scott v Harris...it watched Deputy Scott&#039;s dashcam video!I wouldn&#039;t be complacent. The tone of the opinion concerns me.</description>

		<description>This is an interesting analysis of the 9th Circuit case.  From what I can tell, Taser.com believes the 9th Circuit case doesn&#039;t change anything on the legal landscape.  As long as Taser use is justified in the first place, and then not abused by the officer using it, it is a wonderful tool for law enforcement.

The case, though, seems to say that the 9th Circuit is elevating the Taser above some other non-lethal force - such as pepper sprays and batons.  They called Taser use an &quot;intermediate, significant level of force that must be justified by a strong government interest that compels the employment of such force...&quot;</description>
